Terms of Use

1. Parties and Scope

These terms govern the use of the Argus EMS website at www.argusems.com (the "Site"). The Site is operated by Neva Bina ve Endüstriyel Otomasyon Sistemleri San. Tic. A.Ş. (the "Company"), owner of the Argus EMS brand. By visiting or using the Site you accept these terms; if you do not accept them, please do not use the Site.

2. Use of the Site

The Site provides general information about the Argus EMS energy monitoring platform and services. When using the Site you agree:

• To comply with applicable law and these terms,
• Not to attempt to bypass the Site's security, gain unauthorised access or disrupt its operation,
• Not to run automated crawling or bulk data extraction that overloads the Site,
• To provide accurate information in demo and contact forms.

3. Argus EMS Platform Services

The Argus EMS platform (customer dashboard, field devices, reports and notifications) is provided only to customers that have signed a written service agreement with the Company and to the users they authorise. Use of the platform, scope of service, service levels, fees and data processing are governed by that separate agreement. If the agreement conflicts with these terms, the customer agreement prevails.

Product, feature and service descriptions on the Site are for information only and do not constitute an offer or binding commitment.

4. Calculators and Content

The calculators on the Site (e.g. the reactive penalty and energy calculators), blog articles and guides are for general information. Results are estimates based on the data you enter and current tariffs; they do not replace an official invoice, the distribution company's calculation or legislation. We take care to keep content accurate and up to date but do not guarantee it is complete or error-free.

5. Intellectual Property

Texts, images, videos, software, the logo and the "Argus EMS" brand on the Site belong to the Company or its licensors. Except for short quotations with attribution, content may not be copied, reproduced, modified or used commercially without the Company's written permission.

6. Third-Party Services and YouTube

The Site may contain links to and embedded content from third-party services such as YouTube, LinkedIn, Instagram, Facebook and X. The Company is not responsible for their content or practices; each service is subject to its own terms.

Argus EMS uses YouTube API Services to manage its own YouTube channel (@argusems). By viewing or interacting with our YouTube content you agree to the YouTube Terms of Service. Data processed by Google is subject to the Google Privacy Policy.

7. Privacy and Personal Data

How your personal data is processed, our use of cookies and your rights are explained in our Privacy Policy (KVKK notice).

8. Limitation of Liability

The Site is provided "as is" and "as available". The Company does not warrant that the Site will be uninterrupted, error-free or free of viruses. To the extent permitted by applicable law, the Company is not liable for indirect damages, loss of profit or data arising from the use of or inability to use the Site, or from decisions made in reliance on its information or calculator results.

This limitation does not affect liability that cannot be limited by law (including intent and gross negligence) or the statutory rights of users acting as consumers.

9. Changes

The Company may update these terms at any time. The current text takes effect on the date it is published on this page; the last update date is shown at the top. Continuing to use the Site after a change means you accept the updated terms.

10. Governing Law and Jurisdiction

These terms are governed by the laws of the Republic of Türkiye. Istanbul Courts and Enforcement Offices have jurisdiction over disputes arising from these terms. Consumers' rights to apply to Consumer Arbitration Committees and Consumer Courts under Law No. 6502 are reserved.
